Polestar Performance AB, a Swedish legal entity with company registration number 556653-3096 having its registered office at Assar Gabrielssons Väg 9 405 31 Gothenburg, Sweden, and the (potential) seller of the pre-owned Polestar vehicle, indicated as the "Polestar Pre-owned Partner" on the platform for the sale of pre-owned Polestar vehicles ("Pre-owned Polestar Platform"), hereinafter referred to as "we" and "our," are joint controllers who will process your personal data as described below.
We process the personal data that you provide when you use the Pre-owned Polestar Platform on polestar.com. The purpose of our processing is to promote the sale of pre-owned Polestar vehicles and conclude a sales contract with you, to manage any potential litigation in that regard, and to provide you advice and information.
For our litigation management, we may process your personal identification data (name, [company] address, e-mail address), employment data (if you are a B2B customer), and any other information relevant to the (potential) litigation. This data allows us to defend our legitimate interests in all forms of dispute resolution and the administration of disputes. The legal basis for this processing is the legitimate interest to exercise our rights of defense (art. 6, §1, (f) GDPR). We always obtain this personal data directly from you.
In case of litigation, we may share your personal data with external legal advisors, debt collection agencies, and other third parties (public authorities, judicial authorities, bailiffs) on a need-to-know basis.
In case of litigation, we may store your personal data for up to 5 years after we have concluded the dispute or – in the case of legal proceedings – 5 years after the expiration of any legal recourse
We are committed to ensuring that your information is secure. We have therefore implemented appropriate technical and organizational measures to ensure the confidentiality of your personal data and to protect your data from accidental and unlawful destruction, loss, alteration, unauthorized disclosure, and access.
We have made the necessary contractual arrangements with the third parties with whom we work and will not transfer your personal data outside the European Economic Area without ensuring that your data is granted an equivalent level of protection there.
