We, at Polestar (as defined in Section 1.2 below), want to provide you with the possibility to purchase Services (as defined in Section 2 below) online.
By ticking a box in a digital acceptance process, you acknowledge that you have read these Specific Terms for Purchasing of Services ("Specific Terms") and accept that a binding agreement has been entered into between you and Polestar Performance AB, a Swedish company with registration number 556653-3096, with the address 405 31 Gothenburg, Sweden, (“Polestar” or “we”, “us” or “our”) for the purchase of a Service.
In addition to these Specific Terms, the Terms and Conditions for Services (“T&Cs for Services”), available here, and any additional obligations in your Contract (as defined in Section 2 below) apply to your use and purchase of Services unless otherwise stated in this document.
The T&Cs for Services apply between you and an affiliate of Polestar, and Polestar is acting on behalf of that affiliate under these Specific Terms. Thus, the T&Cs for Services also govern these Specific Terms and the terms therein shall apply also for the undertakings under these Specific Terms.
In order for you to be able to purchase a Service, you must hold a valid Polestar ID.
"Service" means a service purchased from Polestar which can be ordered through the use of a Polestar ID, and which includes but is not limited to connected services (such as Polestar Connect subscriptions), apps and other software.
"Contract" means any contract between Polestar and you pertaining to purchased Services which shall incorporate these Specific Terms.
"Website" means; polestar.com.
Before you can use a Service, you will need to complete an online order process and pay for the Service. Please take the time to read and check your order at each step of the process.
Upon finalising your order you will see an order confirmation on the screen. We will also send you a receipt/invoice email containing relevant details about your order and a unique order ID number that should be referred to in any subsequent queries or correspondence relating to your order. Alternatively, we may contact you to say that we do not accept your order. This is typically for any of the following reasons:
(i) we cannot authorise your payment; or
(ii) you are not entitled to purchase said Service.
A Contract will only be formed when we accept your order in accordance with Section 3.2.
A Service is ordered and paid for online. The price is payable only by commonly used credit or debit cards via a secure online payment system.
We use third party payment services and you agree to the handling of the payment transaction and your card details and any other information necessary for such payment transaction to be executed by said third party (including but not limited to fraud prevention). We only use third party payment services that are certified by banks and card acquirers to securely manage payment transactions. All communication between our Website and your bank is handled by third party payment services.
You may cancel your Contract within fourteen (14) days from the placement of your order without giving any reason.
To exercise your right of cancellation, you must inform us of your decision to cancel the Contract by a clear statement via polestar.com/contact. If you decide to cancel the Contract, we will without undue delay reimburse you for all payments which we have received from you in relation to the Contract. If you have used the Service before you exercise your right of cancellation, we may make a reasonable deduction from the reimbursement corresponding to your use of the Service.
We will make the reimbursement using the same means of payment as you used for the initial transaction. You will not incur any fees as a result of the reimbursement.
Nothing in these Specific Terms will affect your statutory rights, whether in relation to your withdrawal right or otherwise.
